Today, Judge Dowling issued an opinion ultimately granting U.S. Law Shield’s Motion for Preliminary Injunction with respect to three of the five contested ordinances. The Court additionally declined to stay the proceedings, which means the litigation will continue. The Defendants had requested that the attorneys be removed from the case due to an alleged conflict of interest, that proceedings be placed on hold, pending a case in Commonwealth Court regarding Act 192, and all 5 ordinances be approved with the preliminary injunction denied.
The Mayor, and his attorneys, said that he was confident that there would be a stay in the proceedings and that all of the ordinances would be upheld as “common sense” gun laws.
By Order of the Court, the Defendants are enjoined from enforcing the following ordinances until the case is ultimately resolved:
- § 10-301.13 B, C – prohibiting the carry of firearms in city parks;
- § 3-355.2 A (1), (2), (3), B (8) – related to emergency measures; and
- § 3-345.1 – related to restrictions upon minors
