If nothing else, the Can Cannon by X Products sure looks like a lot of fun. But as its popularity has increased, “how is this legal?” styled inquiries have creeped onto online message boards. Many have wondered if the increase of inquiries, popularity and poking of the proverbial bear would doom the Can Cannon with the fate of the Sig Brace (SB-15). It seems we have an answer.
Yesterday, X Products released a statement to its customers referencing a “complete evaluation” from the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) “on the legal status of the Can Cannon . . . .” The verdict? The Can Cannon in and of itself is not a firearm, and not controlled. However, BATFE also determined that if the Can Cannon is placed on a rifle receiver it is a short-barreled rifle (SBR), and if it is placed on a pistol it is considered Any Other Weapon (AOW). Essentially, BATFE found that in the referenced functioning states the Can Cannon is either an SBR or an AOW. Each of these classifications are subject to the National Firearms Act (NFA) and one must acquire a tax stamp in order to legally possess an item in either of these categories. So while it’s not illegal to possess a Can Cannon standing alone, it is illegal and unwise to attach it to a rifle or pistol without a tax stamp. As a result, it looks like it is going to be a bit more difficult (a pain in the can?) to enjoy the Can Cannon as it exists. Get out your Form 1 folks.
But this may not be permanent, because there is potentially good news. X Products assures its customers that they are submitting a revised design of the Can Cannon to BATFE. They are confident that the revised design will address BATFE’s concerns. Until we hear anything further, it looks like we have to keep the Can Cannon off of rifles and pistols barring a tax stamp.
