Breaking News: Yet another defeat for the City in its attempts to keep its illegal gun ordinances
As readers of this blog and readers of the news will recall, US Law Shield of Pennsylvania through The McShane Firm, LLC sued the City of Harrisburg over its illegal gun ordinances in January of 2015 (US Law Shield of PA ex rel Todd Hoover and John Bruno v the City of Harrisburg, et. al.). We just received today a memorandum and order from Judge Andrew Dowling of Dauphin County regarding the latest effort by the City in avoiding responsibility and in its effort to avoid following the law. Attorneys for the City and the Mayor attempted to argue that for various reasons the judge should simply stop all effort on this case in part due to the “uncertain future of Act 192.”
They failed in their attempt.
The May 1st order reads in part as follows:
So far in this litigation, the City has nearly completely lost in every conceivable dimension and at every conceivable point. Despite 8 offers to settle the matter for no fees or expert fees, the Mayor, and the City government seem impervious to the pain of its taxpayers by flushing good people’s hard earned money down the toilet in a vain attempt of what in the best case scenario can be considered a Pyrrhic victory, but in reality is simply foolishness and stubbornness. Hubris in action.
Yes, even the government has to follow the law. We look forward to the very swift resolution of this case and call for an end of the City’s attempts to stall what appears to everyone to be the inevitable conclusion: The City must follow state law.
